1. Acceptance of Terms

By accessing and using Wellaaro's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform.

2. Nature of Our Services

Wellaaro is a medical tourism facilitation platform. We connect international patients with hospitals and doctors in India. We are not a healthcare provider, clinic, or medical practitioner, and we do not provide medical advice, diagnosis, treatment recommendations, prescriptions, or clinical opinions. All medical decisions remain solely between the patient and the treating healthcare provider.

3. No Medical Liability

Wellaaro acts exclusively as an independent patient coordination and support service and is not liable for the quality, safety, or outcome of medical treatment provided by partner hospitals. Medical treatment, procedures, clinical decisions, and outcomes are the sole responsibility of the treating hospital and healthcare professionals. All medical procedures carry inherent risks, and patients are advised to discuss these fully with their treating physicians before proceeding. Wellaaro does not guarantee treatment success, recovery timelines, clinical outcomes, or medical results.

4. Quotations, Service Fees, and Payments

Wellaaro provides patient coordination, treatment planning support, hospital shortlisting, medical record management, travel assistance, and care facilitation services.

• Fees: Certain services may be subject to a Coordination Fee, Service Fee, or Case Management Fee depending on the complexity of the patient's requirements. Any applicable fees will be clearly communicated and agreed upon before the commencement of paid services.
• Third-Party Costs: Hospital treatment costs, surgeon fees, diagnostic charges, accommodation expenses, and other third-party costs are separate and are payable directly to the respective service providers unless otherwise specified. Wellaaro remains committed to providing transparent pricing and unbiased guidance.
• Validity: Quotations are valid until the validity date stated. After expiry, pricing and availability may be subject to revision based on hospital tariffs, physician availability, and prevailing market conditions.
• Estimates: All treatment costs provided are estimates based on the medical information and reports submitted by the patient. Actual costs may vary depending on confirmed diagnosis, treatment complexity, additional investigations, procedures, complications, implant selection, ICU stay, or extended hospitalization.
• Confirmation: No booking shall be considered confirmed until the required advance payment has been received. Upon receipt of payment, Wellaaro will initiate treatment coordination and appointment scheduling. Booking confirmation shall be issued via email.

5. Exclusions

Unless specifically stated in writing, quotations do not include:

• International airfare and local transportation
• Visa fees
• Travel insurance
• Accommodation and personal expenses
• Interpreter services and companion expenses
• Post-treatment tourism activities
• Any medical services not specifically mentioned in the quotation

6. Cancellation & Refund Policy

• Refund requests must be submitted in writing.
• Any approved refund shall be calculated after deducting: actual coordination and administrative costs incurred, payment gateway charges, bank transfer fees, currency conversion charges, and any third-party expenses already paid on behalf of the patient.
• Refunds, if applicable, will be processed within 10 business days of approval of cancellation.

7. User Responsibilities

You agree to provide accurate, complete, and up-to-date medical information, reports, imaging, and health history when submitting inquiries. Providing false or misleading medical information may result in incorrect treatment recommendations and could jeopardise your health and safety. Wellaaro bears no liability for medical errors or complications arising from incomplete or inaccurate patient-provided information.

8. Right to Withdraw Services

Wellaaro reserves the right to withdraw coordination services without refund of any advance payment if a patient is found to engage in abusive, fraudulent, or non-cooperative behaviour toward Wellaaro staff, hospital partners, or medical professionals.

9. Visa and Force Majeure

Visa approvals or refusals remain solely at the discretion of the relevant government authorities. Wellaaro cannot guarantee visa issuance. Wellaaro shall not be responsible for delays, cancellations, or disruptions arising from circumstances beyond its reasonable control, including but not limited to: government restrictions, visa delays or refusals, airline disruptions, natural disasters, pandemics, civil unrest, hospital scheduling changes, and other force majeure events.

10. Intellectual Property

All content on this platform — including text, graphics, logos, and software — is the property of Wellaaro and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

11. Limitation of Liability

To the maximum extent permitted by law, Wellaaro's total liability, if any, shall be limited solely to the service coordination fees paid directly to Wellaaro. Under no circumstances shall Wellaaro be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, medical outcomes, treatment complications, travel disruptions, or failures of third-party service providers.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of our services after any modification constitutes your acceptance of the new terms. We encourage you to review these Terms periodically.

13. Governing Law & Jurisdiction

Both parties agree to make reasonable efforts to resolve disputes amicably before initiating legal proceedings. These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat, India.
